- Governing Law. These Official Rules and the Contest, and any action related thereto, will be governed by the Federal Arbitration Act, federal arbitration law and the laws of the State of California without regard to conflict of laws provisions. Except as otherwise expressly set forth in Section 11 “Dispute Resolution and Arbitration” the exclusive jurisdiction for all Disputes (defined below) that you and Sponsor are not required to arbitrate will be the state and federal courts located in Santa Clara County, California and you and Sponsor each waive any objection to jurisdiction and venue in such courts.
12. Dispute Resolution and Arbitration
(a) Mandatory Arbitration of Disputes. We each agree that any dispute, claim or controversy arising out of or relating to this Contest and these Official Rules or the breach, termination, enforcement, interpretation or validity thereof or participation in the Contest (collectively, “Disputes”) will be resolved
solely by binding, individual arbitration and not in a class, representative or consolidated action or proceeding. You and Sponsor agree that the U.S. Federal Arbitration Act governs the interpretation and enforcement of these Official Rules, and that you and Sponsor are each waiving the right to a trial by jury or to participate in a class action. This arbitration provision shall survive termination of these Official Rules.
(b) Exceptions. As limited exceptions to Section 11(a) above: (i) we both may seek to resolve a Dispute in small claims court if it qualifies; and (ii) we each retain the right to seek injunctive or other equitable relief from a court to prevent (or enjoin) the infringement or misappropriation of our intellectual property rights.
(c) Conducting Arbitration and Arbitration Rules. The arbitration will be conducted by the American Arbitration Association (“AAA”) under its Consumer Arbitration Rules (the “AAA Rules”) then in effect, except as modified by these Official Rules. The AAA Rules are available at
www.adr.org or by calling 1-800-778-7879. A party who wishes to start arbitration must submit a written Demand for Arbitration to AAA and give notice to the other party as specified in the AAA Rules. The AAA provides a form Demand for Arbitration at
www.adr.org. Any arbitration hearings will take place in the county (or parish) where you live, unless we both agree to a different location. The parties agree that the arbitrator shall have exclusive authority to decide all issues relating to the interpretation, applicability, enforceability and scope of this arbitration agreement.
(d) Arbitration Costs. Payment of all filing, administration and arbitrator fees will be governed by the AAA Rules, and we won’t seek to recover the administration and arbitrator fees we are responsible for paying, unless the arbitrator finds your Dispute frivolous. If we prevail in arbitration we’ll pay all of our attorneys’ fees and costs and won’t seek to recover them from you. If you prevail in arbitration you will be entitled to an award of attorneys’ fees and expenses to the extent provided under applicable law.
(e) Injunctive and Declaratory Relief. Except as provided in 11(b) above, the arbitrator shall determine all issues of liability on the merits of any claim asserted by either party and may award declaratory or injunctive relief only in favor of the individual party seeking relief and only to the extent necessary to provide relief warranted by that party’s individual claim. To the extent that you or we prevail on a claim and seek public injunctive relief (that is, injunctive relief that has the primary purpose and effect of prohibiting unlawful acts that threaten future injury to the public), the entitlement to and extent of such relief must be litigated in a civil court of competent jurisdiction and not in arbitration. The parties agree that litigation of any issues of public injunctive relief shall be stayed pending the outcome of the merits of any individual claims in arbitration.
(f) Class Action Waiver.
YOU AND SPONSOR AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE PROCEEDING. Further, if the parties’ Dispute is resolved through arbitration, the arbitrator may not consolidate another person’s claims with your claims, and may not otherwise preside over any form of a representative or class proceeding. If this specific provision is found to be unenforceable, then the entirety of this Dispute Resolution and Arbitration section shall be null and void.
(g) Severability. With the exception of any of the provisions in Section 11(f) (“Class Action Waiver”), if an arbitrator or court of competent jurisdiction decides that any part of these Official Rules is invalid or unenforceable, the other parts of these Official Rules will still apply.
- Entrant's Personal Information. Information collected from entrants is subject to the PUBG MOBILE Privacy Policy, which is available at https://www.pubgmobile.com/privacy.html.

2023.06.07 19:13 WorkingLegForOregon Lets discuss amending the Oregon Constitution to set the quorum threshold for the Oregon Legislature to a simple majority!
TLDR; Let's discuss getting a citizen initiative to reduce the Oregon Legislature's quorum from a ⅔ to a simple majority.
Here is the text of my proposed constitutional amendment/ballot initiative. Hey Reddit,
At this point, most of us have seen at least some news regarding the current (and recurring) walkout by Oregon Senate Republicans so that the Senate cannot be convened into session as there is no quorum present. I want to change that. My proposal is a simple change to our state constitution:
set the quorum required for either chamber of the State Legislature to be convened into session to be a simple majority.
This would eliminate the ability for the minority to shut down the legislature over some bills they don’t think are suitable to implement.
To be clear, the minority still gets a vote, they are still entitled to debate and to state their views, they just won't be able to block legislation if they can't convince the majority to vote with them on it.
Now I understand this isn’t entirely without its risks, and anything political gets people antsy, so I wrote up this FAQ about my plans.
What exactly are you proposing? I’m proposing a state constitutional amendment that does two things: - Edits Article IV, section 12 to set the quorum during a non-emergency session to a simple majority
- Edits Article X-A, section 3 to adjust the language around quorum in a catastrophic emergency to reflect that a quorum is usually a simple majority.
What about the risks of reducing the quorum? Couldn’t the majority just run the table? First, let’s look at the facts. A total of 4 states require a two-thirds majority to constitute a quorum (Oregon, Texas, Tennessee, and Indiana). One state, Massachusetts, sets the threshold at about a two-fifths majority (two-fifths for the state senate, three eights for the state house).
Every other state, 45 plus the U.S. Congress, set a quorum of their legislative bodies as a simple majority.
Could it be a problem if the majority decides to enact lousy legislation in the future? Sure, but right now, having a two-thirds majority quorum threshold allows the minority to block all legislation. Since 45 states manage to survive with a simple majority quorum requirement, I'd fix the issue we have today rather than worry about a potential problem the solution may cause.
Who are you, and why do you care? My name is Todd. I’m a dad, a software engineer, and (basically) a lifelong Oregonian. I’ve lived in the Willamette Valley for most of my life and currently live in the SW suburbs of Portland.
I believe politics will always be messy, but it’s at its best when debate is held and heard. I appreciate exchanging ideas and believe that if an argument is persuasive enough, you might even be able to change a few minds.
The current system allows a minority of senators to not only shut down the session but also to disallow debate on an issue. I disagree with that tactic in every way imaginable. If you want your views should be implemented, you must convince the majority to support your ideas, not just take your ball and go home.
I also want to note that while I am a registered Democrat, I have no professional ties to the Democratic Party of Oregon or any unions, corporations, or committees trying to influence Oregon politics. I genuinely am a concerned citizen trying to make a difference.
Why are you the right person to try to pull this off? I don't know that I am. I'm not a lawyer and have never been that involved with the political process. I'm happy to let someone with more experience lead the effort, but someone needs to get the ball rolling. I'm happy to chat if anyone wants to help get this off the ground!
Ok, so what's next? As I said, I'm not a lawyer and have no real experience, so I'm going off the
information the Secretary of State provides. It seems like the basic process is as follows:
- File an SEL 310 Prospective Petition
- This requires including the text of the initiative. I've put a draft together, but I'd prefer to have it reviewed by someone who knows the process's ins and outs to ensure I don't create unintended side effects.
- Get 1000 sponsor signatures.
- Have the initiative approved and have a ballot title drafted by the Attorney General.
- One approved 160k signatures must be collected by July 2024 to qualify for the ballot in November 2024.
So what do you all think? Do you think this is something we should pursue? Are there other consequences we should be thinking about?
Thanks!

2023.06.06 04:58 yellowfoam Delay tactics and being on the offense
I filed for divorce from my wife May 5 (Tennessee). I was served with a temporary OP the day before and was order to vacate my home with very little clothing. It has been 30 days and I have yet to get the remainder of my belongings. My attorney has attempted to get cooperation from my stbx's attorney via email and phone. Today I was told I they didn't want me to come in the house or even the drive because of the OP. Clothing would be placed at the end of the driveway. I told my attorney that this was unacceptable and that was only being used to delay, cause embarrassment, and undue duress. I asked her to file a motion for a hearing to get my personal valuables and belongings.
Also, to prevent further delay I asked my attorney to schedule mediation or compel the court to do so. I want this over as quick as possible and I made that perfectly clear with my attorney.
Even though I am only 30 days in my divorce I know how vindictive my stbx can be. What are some other things I can do to prevent their delay tactics? Should I ask the have the court to order scheduling?

2023.06.05 02:48 trireme32 NY: Brother is entering hospice for last stages of terminal cancer, sister-in-law doesn't even know what she needs or what she doesn't even know about.
My brother was diagnosed with cancer about 3.5 years ago. Within the next few days he will be moved into hospice care, and the end is coming soon. I'm not sure what they spent the past 3.5 years doing, but my sister in law doesn't even know what she doesn't know. My wife and I are trying to help her get things moving in the right direction,
quickly.
- She does not have any sort of POA, nor are there any wills at all.
- She does not know if he has a 401k or other type of retirement earnings.
- The house is in both of their names.
- She has no login info for any of his side of their banking or finances.
- She does not know if he has life insurance, or its status if he does.
- He is insisting that she does not contact his employer, for whom he's been working for over 20 years, so she can't get any info regarding benefit status (out of denial, not malice).
What documents should she start preparing ASAP? Can most be prepared by one's self/through a website? We don't even know if there will be time to actually meet with any attorney at this point. Do things need to be notarized? What does she have to make sure she has
him sign while he's still physically and mentally able?
What else are we missing?

HOW WE GOT HERE:
Brad Holmes is a wizard. What he has done as the Detroit GM in just 3 years has been a playoff push away from being quite remarkable, especially considering the context of succeeding prior general manager Bob Quinn which ended in typical Lions losing fashion. Brad Holmes would immediately come out swinging and first transaction as general manager was trading longtime franchise quarterback Matthew Stafford to the Los Angeles Rams in exchange for two first round picks, a third round pick, and quarterback Jared Goff. At the time, it was bittersweet for fans, as Stafford was the practically the lone bright spot in the last decade (outside of Megatron), but the haul they got in return was at least something. Stafford was injured and already likely leaving to chase a Super Bowl and Detroit was going into full rebuild mode so Detroit fans were just happy with what they could get. Brad ended up hiring a one time Head Coach, Dan Campbell. A pick made purely on the potential he would be able to change the culture with his grind it out, Football attitude Campbell was known for. All in all, it was business as usual for Detroit as they begin yet another rebuild....
Oh parity in sports.... You never cease to amaze us....
Somehow and someway, In Holmes' first draft, Penei Sewell falls to Detroit at #7 and the Lions draft room goes bananas on camera! At the time we did not know it, but Detroit just landed their future Pro Bowl leader in the trenches. In round 4, the Lions scoop a literal Sun God in Amon-Ra St. Brown. Little did we all know the impact both of these players would have today. Both players are arguably top 10 in their position.
Fast forward to 2022 and the Lions are coming off one of the most promising 3-13-1 seasons that you could ever ask for. The team and coaches have bought in to Dan Campbell's grind it out style of Football. The culture seemed to finally be changing and it felt like Jared Goff turning into a solid Stafford replacement, despite being considered a throw on by most in the Stafford trade.
The 2022 draft Brad Holmes' statement to the NFL. It does not matter where you take guys. If you know how to evaluate talent, you go for YOUR guys and you can be successful. Holmes was able to draft Aiden Aiden Hutchinson at #2 (some say he should have been #1), Jameson Williams (best receiver in the draft at 12 via trade), Kerby Joseph (who picked off Aaron Rodgers THREE TIMES IN ONE GAME!), and drafted James Houston and Malcolm Rodriguez in the 6th round. Both players are looking like future defensive stars. Dare I say the best 6th round success since the Pats drafted TB12? Don't @ me lol
The Lions followed up the draft with a MUCH improved 2022, landing a 9-8 winning record and going 8-2 in their final 10 games. Jared Goff is looking like the guy who took the Rams to the Superbowl, every position has young talent and this upcoming 2023 draft is looking like it could seriously push the Lions into serious playoff contention if the cards are played correctly.

Round 1: No. 12 (from CLE through HOU and ARI) – Jahmyr Gibbs, RB, Alabama
Flashback! Remember that Stafford trade where they got got the Rams draft pick? You know that pick that was supposed to be in the upper 20s because LA is so good and are coming off winning a Super Bowl? Yea, well they sucked.... Somehow they sucked so bad that that pick turned into the number 6th overall pick.
Odds makers had the Lions grabbing Devon Witherspoon as their secondary was a big need. However when Seattle took him at 5, who knew what would follow? Well, the last thing fans expected.... The Lions ended up passing on Tyree Wilson, Jalen Carter, AND Bijan Robinson by trading down to 12 to take Alabama running back, Jahmyr Gibbs. Hindsight is 2020, but reports now show the Lions wanted Jahmyr over Bijan, which means Holmes and co. got THEIR guy.
Immediately fans realized the inevitable. Fan favorite and oft injured running back, DeAndre Swift, was going to be cut or traded. Almost immediately they traded D'Andre Swift and a 7th round pick for the Saints' 2025 fourth-round pick and a 2023 7th round pick.
This pick is exactly why you and I are sitting on the couch and Brad Holmes gets paid the big bucks. "HoW cAn YoU dRaFt a RuNnInG BaCk ThAt hIgH". Well, the dude is a straight up baller. If I asked you who led Alabama in receiving last year you would probably say some 5 star Wide Receiver. It was Gibbs. Gibbs is being compared Alvin Kamara in the way he can run and catch. He was listed as running a 4.36 at the combine. Gibbs transferred to Alabama last season after spending the first two seasons of his career at Georgia Tech. He carried the ball 151 times for the Crimson Tide in 2022, averaging 6.1 yards per carry and scoring seven touchdowns. He also caught 44 passes for 444 yards and three catching scores. With the departure of Swift and the newly acquired bowling ball back in Montgomery, Gibbs is going to be an immediate impact as a "weapon" and less of a conventional running back. The thunder and lightning combo the Lions will have will be fun to watch behind their top 5 O Line.

Round 1: No. 18 – Jack Campbell, LB, Iowa
"HoW cAn YoU dRaFt a RuNnInG BaCk ThAt hIgH" made sense with the Gibbs pick, but drafting a Linebacker at 18 with other glaring needs like lineman and secondary left Lions fans a bit puzzled by this pick. It hurt a little less when you remember this was their 2nd pick in the first round. Also, many people had Jack Campbell on their board for later in the draft so in terms of liking a guy for who they are, very few people are against this pick. But like I said before, Brad Holmes and Dan Campbell go after guys they have faith in. Until they screw up, fans cant complain too much!
But who is this guy and what makes him so good? Well if you care about RAS or "Relative Athletic Score" Jack is outstanding. He scored a 9.98 RAS out of a possible 10.00. This ranked 6 out of 2600 LB from 1987 to 2023. He possesses rare athleticism for being 6-5 and that allows him to be exceptional in coverage. PFF rated him as the highest coverage grade since 2018 Devin White at LSU. He also has great leadership skills as he was Iowa's team captain and won Big10 Defensive Player of the year.
Jack Campbell is going to join a much improving linebacking core that is led by team captain Alex Anzalone and 2nd year stars Malcolm Rodriguez and James Houston. The Lions will likely play him on the outside because off his athleticism but I am certain he will be moved all around the field.
_______________________________________________________________________________________________________
Round 2: No. 34 (from ARI) – Sam LaPorta, TE, Iowa
This is getting a bit out of hand for the Lions fans that appreciate positional value when you draft. Clearly Holmes has totally thrown conventional wisdom out of the window. However, tight end IS a need. Of all of the positional units Tight End is probably the weakest. In 2022 the Lions trotted Brock Wright, James Mitchell, and Shane Zylstra....WHOOOO?!?! Exactly...they needed help. Outside of when they took him, most pundits are pretty happy about this pick. Not only did the Lions get their second Iowa captain, but Sam might have landed the best tight end in the entire class.
With LaPorta, the Lions get a player that can do a variety of things. He can play in the slot, in-line or even out wide. This is EXTRA important when you remember that Jameson Williams is suspended for 6 games due to gambling. During his career at Iowa, he had 513 snaps in-line and 304 snaps out of the slot (per PFF). It really wouldn’t be surprising if LaPorta walks into Detroit and earns the starting tight end spot. He has the talent to do it and by being the 34th overall pick, there is going to be some high expectations for him.
________________________________________________________________________________________________________
Round 2: No. 45 (from DET) – Brian Branch, S, Alabama
For the first time all draft it felt like a player fell to Detroit and they werent reaching for their guy (for better or worse). At 45, the Lions were already drafting their 4th player and wasnt even the end of the 2nd round. Scouts said that Branch was one of the safest picks in the draft due to his lack of a jarring weakness. Branch is siad to have extremely high football IQ which led him to play all around the defense for the Crimson Tide. Branch has primarily handled nickel coverage, but has the range and instincts for single-high or split safety looks. He’s quick, fast and strong with the ability to match up with shifty slots, bigger possession receivers and pass-catching tight ends. Branch is also tough and gritty which makes himu a perfec fit for this Lions team. He has a nose for the ball and is capable of making game-changing plays. He had two interceptions and two forced fumbles during his freshman season at Bama.
Branch made headlines on draft day to be the only guy to stay into day 2 in the greenroom as he was projected to go in the first round. I think that shows how much he cares about this opportunity and has his heart in it.
Also, Branch as a great opportunity to learn from newly acquired Safety, Chauncy Gardner-Johnson who is one of the best young safeties in the league.

Round 3: No. 68 (from DEN) – Hendon Hooker, QB, Tennessee
You ever feeling a little uncomfortable and then you let out a massive fart and all of your uneasiness washes away? Yea, well thats the feeling Lions fans got when they landed Hendon Hooker with the 68th pick. QB wasnt a terrible need, but once we got him, a sense of relief was felt across the fanbase. When the Lions ended up getting Goff in the Stafford trade, it was sort of unsaid that Goff was just the bridge before they draft a QB of the future. However Goff has played way better than expectations and less and less fans are calling for a replacment. So, instead of using one of their first round picks on a QB, they waited and got a guy with first round updside! Now, they are in a much more confortable position at QB with a very solid back up.
The Lions used the 68th pick in order to take the former Tennessee quarterback. The pick came just before the Rams and Raiders were scheduled to pick and been teams have been seen as possible landing spots for a quarterback in this year’s draft. Hooker is recovering from a torn ACL, but his doctor recently informed teams that he is expected to be ready to go by the first week of the regular season. With Jared Goff in place as the starter in Detroit, there won’t be any need for Hooker to rush back for what will likely be a redshirt season if all goes according to plan in Detroit.
This pick was safe, exciting, and sets the Lions up with a solid back up QB. The first time that they can say that since they had Shaun Hill.
________________________________________________________________________________________________________
Round 3: No. 96 (from ARI) – Brodric Martin, DT, Western Kentucky
Before the draft, a need that was discussed as a hole in the Lions defense was interior line. They got their big boy in the middle with nose tackle, Brodric Martin. After starting his career at North Alabama, Martin transferred to Western Kentucky to play his final two seasons at the FBS level. Since 2021, Martin has played in 26 total games, and has managed to contribute 62 total tackles to the Western Kentucky cause. He’s piled up six tackles for-loss as well as four sacks, one fumble recovery and one forced fumble. This move with help the Lions run defense that ranked 4th to last in the NFL last year.
It is no surprise that winning is won in the trenches. The Lions have done a great job of drafting players to build out this line with the likes of Alim McNeill, Isaiah Buggs, and John Cominsky, but with big interior guys like Martin, they usually operate best in a rotation. This move should be huge in terms of depth and opening up even more opportunities for Aiden Hutchison to get to the QB.
This move didn't feel flashy, but it felt needed.
________________________________________________________________________________________________________
Round 5: No. 152 – Colby Sorsdal, OL, William & Mary
The Lions had to finally wait a bit before this pick due to moving around in the draft and trading away their pick round 4. They elected to add depth to their O-Line by taking Colby Sorsdal out of William and Mary. Sometimes its fun being the big fish in the small pond. Sorsdal started in all 46 games he appeared in during his five-year stint at William & Mary. He spent the duration of his college career at Right Tackle. Sorsdal is the first Tribe player to be drafted since 2016, when the Chicago Bears selected safety DeAndre Houston-Carson in the sixth round.
Serving as an offensive co-captain and starting all 13 games at Right Tackle, Sorsdal anchored an offensive line that helped the Tribe rank third in total rushing offense and fourth in fewest sacks allowed. Behind one of the best offensive line units in the country, the Tribe accumulated an 11-2 record and won the CAA Conference Championship for the first time since 2015.
He will be joining a elite O-line led by Penei Sewell, Frank Ragnow and Taylor Decker. Colby wont start, but he will add in needed depth for a team that's success will only goes as far as their line will take them.
________________________________________________________________________________________________________
Round 7: No. 219 (from HOU through MIN via PHI) – Antoine Green, WR, North Carolina
With the Lions last pick in a very intense draft, they selected Wide Receiver, Antoine Green out of UNC. Most projected Antoine to be signed to a team after the draft so it is a but of a peculiar pick. In the late 7th round, you are just hoping to take a flier on a guy and hoping they pan out.
The 6-foot-3, 199-pound receiver impressed Detroit's coaching staff at the East-West Shrine Bowl, and has the opportunity to compete for playing time his rookie season. According to NFL Draft Bible, Green is a "technically sound, fluid athlete that can give you a little bit of everything as a wide receiver. Green runs routes, it is as if he is attacking his defender rather than going about his route without considering what the defense is doing. Green has a good release off the line of scrimmage and does not get held up too much when facing press coverage. He uses his hands well to reduce contact against the press and accelerate off the line. He analyzes coverages well and makes quick decisions on how to break down his defender throughout his route. He can read zone defenses and has a knack for finding spaces to make himself an easier target."
With Jameson Williams missing 6 games to start the year, there is an opportunity for Green to poach snaps away from anyone not named Amon-Ra or Marvin Jones. There is also a chance he doesn't make it out of camp. Unlikely, but we will see.
________________________________________________________________________________________________________
Conclusion:
The 2023 NFL draft for the Detroit Lions was a resounding success. They were able to draft 6 times....BEFORE THE FOURTH ROUND!! The extra picks allowed Detroit to really control the draft and move around in a way to get the guys they wanted. They did not care about who they got and when. They just simply got the guys they wanted. After reflecting on its entirety, they landed a lot of great talent. They were able to add a player at every single positional unit and several will end up starting and making an immediate impact.
Look, the Lions are going to Lions so hold your breath a little longer, however Brad Holmes and Jack Campbell have really turned this franchise around and are making them a legit playoff contender. Right now the Lions are favored to win the NFC North for the first time since god knows when. I am projecting a record of 12 and 5 and a NFL North Division Win.
GO LIONS!!!! (FTP)

2023.06.03 22:15 Joadzilla Trump-appointed federal judge rules Tennessee’s anti-drag show law is ‘unconstitutional’
https://edition.cnn.com/2023/06/03/politics/tennessee-drag-ban-law-unconstitutional/index.html
A federal judge in Tennessee has ruled that a state law limiting public drag show performances represented an “unconstitutional restriction on the freedom of speech.”
“As a matter of text alone, the (Adult Entertainment Act) is a content, and viewpoint-based restriction on speech. The AEA was passed for the impermissible purpose of chilling constitutionally-protected speech,” US District Court Judge Thomas Parker, an appointee of former President Donald Trump, said in a 70-page late-Friday ruling.
Parker, who called the law “unconstitutionally vague and substantially overbroad,” also barred the defendant in the case – the district attorney of Shelby County, which is home to Memphis – from enforcing the law in that county.
The court ruling comes after Friends of George’s, a Memphis-based nonprofit that produces drag performances and comedy sketches, sued in March to stop the law from going into effect, arguing it was a violation of its free speech. Parker then temporarily blocked the state from enforcing the ban as he considered the law’s constitutionality.
Tennessee Republicans, who hold supermajorities in the state legislature, earlier this year passed the measure to restrict public drag show performances, which was signed by Republican Gov. Bill Lee. The law sought to limit “adult cabaret performances” on public property to shield children from viewing them, threatening violators with a misdemeanor and repeat offenders with a felony. The ban specifically included “male or female impersonators” who perform in a way that is “harmful to minors.” It had been set to go into effect April 1.
“WE WON!” Friends of George’s wrote in a tweet Saturday. “Judge Parker has declared Tennessee’s anti-drag law unconstitutional!”
Tennessee officials have argued that the measure is not a full ban and is only intended to stop overtly sexual performances in front of minors. Parker, in his ruling, acknowledged the state’s “compelling interest in protecting the psychological and physical wellbeing of children” but ruled against the law as “an unconstitutional restriction on the freedom of speech.”
Tennessee Attorney General Jonathan Skrmetti said in a statement Saturday that his office was reviewing the order and expects to appeal “at the appropriate time.”
“The scope of this law has been misrepresented in public by those more interested in pressing a narrative than in reading the statutory text,” Skrmetti said. “The Adult Entertainment Act remains in effect outside of Shelby County. This narrowly-tailored law protects minors from exposure to sexually explicit performances. Its operative language is rooted in the U.S. Supreme Court’s long-established First Amendment precedent.”
CNN has also reached out to Lee’s office for comment.
Tennessee’s law is just one of a slew of other similar measures that Republican-led state legislatures across the country have considered this year.
Florida Gov. Ron DeSantis, who is running for president, signed a bill last month that, among other things, gives his administration the power to take away licenses from establishments if they allow children into an “adult live performance,” widely interpreted as a crackdown on drag shows.
Montana Gov. Greg Gianforte signed legislation in May that prevents children from attending “sexually oriented shows” and from being present at obscene performances on public property. It specifically targets drag story hours, which it defines as “an event hosted by a drag queen or drag king who reads children’s books and engages in other learning activities with minor children present.”
Republicans say the performances – which often feature men dressing as women in exaggerated makeup while singing or entertaining a crowd, though some shows feature bawdier content – expose children to sexual themes and imagery that are inappropriate. LGBTQ advocates, however, argue that not all drag shows are sexual in nature and laws such as the ones in Montana and Tennessee stigmatize the community and could violate the First Amendment.

2023.06.03 21:56 865TheChad "Substantiated" sexual assault against adopted daughter
- My cousin has had some issues over the last several months. I'll give a brief rundown: He was accused of inappropriately touching his adopted daughter. He has maintained his innocence from the beginning. There are a lot of reasons why her story is doubted, but that's for another day
- He spoke with detectives. He offered exculpatory evidence, but they were uninterested.
- He received a letter from DCS (Tennessee) stating that the case was closed and that he had been "substantiated" as committing "sexual assault" on his daughter. The letter was accompanied with a form to appeal the findings. He scanned/emailed his attorney the letter and form. His attorney filled out the form and sent it to DCS.
- **IMPORTANT** The letteform had been addressed to my cousin's home address. He had been moved out of the house before the accusations were made. The letteform had been forwarded to his PO Box. However, when the attorney filled out the appeal form, he used the address that was on the letter (the home that his wife/children live in). If that didn't make sense, please re-read, because it's critical.
- The letter had outlined that if the appeal form was sent in, it would be promptly followed up by DCS with instructions on how to prepare the appeal information. However, since the attorney incorrectly addressed the appeal form, DCS sent it to the home his wife is at. His Post Office stopped forwarding mail to his PO Box, so he never saw the instructions. The appeal instructions were sent by DCS to the address that his wife is at, so he never saw it and she denies recieving it.
- The attorney says that the follow-up instructions from DCS would have had a deadline of when to submit the documents. They would have sent this in early-mid January, so the deadline is very-long past. He insists that once the deadline has past they will not offer accommodations under any circumstances. But it's his fault! Is this malpractice?
What options does he have?? Thanks

2023.06.03 18:21 Gist_it A federal judge rejects Tennessee's anti-drag law as too broad and vague
A federal judge ruled Tennessee's anti-drag law as unconstitutional due to being vague and overbroad.
The ruling: U.S. District Judge Thomas Parker stated that the law encouraged "discriminatory enforcement." * He differentiated between material deemed "obscene" in the vernacular and under the law. * Parker was appointed by former President Donald Trump.
The lawsuit: Memphis-based Friends of George's filed the complaint, arguing the law would negatively affect their drag-centric performances and plays with no age restrictions. * Republican Gov. Bill Lee and Attorney General Jonathan Skrmetti were initially listed as defendants, but later dismissed. * Skrmetti still represented Shelby County District Attorney General Steven Mulroy in this case.
The law's implications: Tennessee's anti-drag law aimed to restrict drag performances from taking place in public or where children could view them. * The law did not use the word
"drag," but redefined adult cabaret to include
"male or female impersonators." * It would have banned adult cabaret performances from public property or anywhere minors might be present, with performers risking misdemeanor or felony charges.

2023.06.03 11:42 kittehgoesmeow What A Day: Border To Tears by Julia Claire & Crooked Media (06/02/23)
"A couple very good guys wrote an article today, the tobacco king, you the tobacco king..." - Disgraced former president Donald Trump doing some classic word salad during his Fox News town hall with Sean Hannity Law And Border
Some variation on “CHAOS AT THE BORDER” is a staple phrase in the Fox News chyron. But the source of that chaos is not who they want you to think it is. - The Trump-era policy known as Title 42—which allowed American border agents to rapidly expel many migrants to Mexico or other countries to request asylum—expired in May, and conservative media whipped its viewership into a frenzy anticipating a huge increase in illegal crossings at the Southern border. That hasn’t happened. What has happened is a crisis of a different kind.
- An internal Border Patrol investigation found that medical staff “declined” (refused) to review the file of an eight-year-old girl with a chronic heart condition and a rare blood disorder before she had a fatal seizure on her ninth day in custody. Her parents had shared her medical history with authorities the second day the family was in custody. Anadith Alvarez was the daughter of Honduran immigrants, born with a congenital heart defect that required surgery three years ago. The day before she died, the girl had a fever of almost 105 degrees.
- The video surveillance system where the girl’s family was detained in Harlingen, TX, had been out of service for over one month, a violation of federal law that prevented authorities from collecting evidence, but interviews with Border Patrol agents and medical personnel there raised enough troubling questions to trigger an investigation into the girl’s nine days in custody. The agency’s own limit to detain migrants is 72 hours. The Office of Professional Responsibility (which is like Border Patrol’s office of internal affairs) reported that despite the girl’s rapidly deteriorating condition, her mothers concerns, “and the series of treatments required to manage her condition, contracted medical personnel did not transfer her to a hospital for higher-level care.”
This is far from the first report of this kind detailing inhumane treatment of migrants at the U.S.-Mexico border. - Adding to the unstable conditions at the border, the head of the U.S. Border Patrol, Chief Raul Ortiz, announced his retirement Tuesday night, which will take effect on June 30. It is unclear who will replace him. Ortiz oversaw Border Patrol’s nearly 20,000 agents during the pandemic and through the implementation of Title 42 after beginning his tenure in August 2021 following the ouster of MAGA-head Rodney Scott, who fully embraced Trump’s policies including #BuildTheWall. But the malpractice plainly did not end with Scott’s removal.
- During the Biden administration, agents have continued to engage in “unnecessary use of force” against non-threatening Haitian migrants. Biden’s own DOJ defended the continuation of Trump’s family-separation policy in court, despite his past criticisms of the policy as “criminal.” Since taking office, Biden has tightened standards for asylum seekers at the border to the degree that some argue he has all but eliminated the right to seek asylum on American soil. Seeking asylum is an internationally protected right, so it doesn’t feel particularly radical to criticize the policy choices that led to this.
President Biden, like President Obama before him, made a wager: that tough border policies and deportations will buy good will from conservatives or neutralize their bad-faith attacks. Except, it didn’t, and it won’t. Conservative media and GOP lawmakers will always portray Democratic presidents, falsely, as open-borders fanatics, no matter how strict their actual immigration policies are. Multiple GOP governors thousands of miles from the border have deployed national guardsmen to Texas, absent a big uptick in crossings, as a propaganda feint, to create the false perception of disorder. Democrats can’t beat that approach by meeting it in the ever-shifting middle, and they shouldn’t try.

Under The Radar
A series of investigations found that Allina Health System, a “nonprofit” that runs more than 100 hospitals and clinics in Minnesota and Wisconsin has repeatedly withheld care from patients who have unpaid medical bills as a draconian bill-collecting tactic. The network rakes in over $4 billion in annual revenue. In the for-profit American healthcare system, many hospitals are known to take aggressive measures to collect medical debt, including taking patients to court, garnishing their wages, or even seizing their tax refunds. Allina Health System, on the other hand, has an explicit policy to completely shut off non-emergency health services for patients with at least $4,500 in unpaid medical debt, and not allow them to resume receiving treatment until it’s paid off in full. At point, the electronic health-records system locks so that staff cannot schedule future appointments for those patients, even ones with chronic conditions requiring regular attention like diabetes and cancer. That confronts those patients with a choice between getting a loan approved through the hospital or filing for bankruptcy. Anyone in this country who has ever been on the wrong side of a health-insurance dispute knows how easy it is to rack up $4,500 in medical debt. Almost one-in-three Americans have medical debt, which accounts for about half of all outstanding debt in this country. Because Allina Health System is a “nonprofit” it was able to avoid $266 million in state, local, and federal taxes in 2020 alone. Another perfect day in the American health-care industrial complex!
What Else?
The Department of Labor’s monthly jobs report showed the 29th straight month of strong job growth, with employers adding 339,000 jobs in May. The U.S. Senate passed the bipartisan ransom note to suspend the debt limit, averting what would have been the nation’s first-ever default. The bill now heads to President Biden’s desk for signature.
The Senate voted to rescind President Biden’s student-loan forgiveness program, a measure the president is (obviously) expected to veto. YouTube will reverse its election-integrity policy, and allow election-denial videos on the platform. Great! I love when corporations sacrifice democracy to extract just a little bit more profit.
Disgraced former president Donald Trump’s lawyers have informed the DOJ that they can’t find the classified document about military operations in Iran that Trump was recorded referencing. Very likely story!
The Justice Department will not seek charges against former Vice President Mike Pence for his possession of potentially classified government documents, and the investigation has been closed. The Fulton County, GA, District Attorney’s investigation of disgraced former president Donald Trump and his efforts to overturn the 2020 election has expanded to include activities in Washington, DC, and several other states. More than 800 million trees have been cut down in the Amazon rainforest in just the past six years to meet global beef demand. Gov. Bill Lee (R-TN) accused the National Rifle Association of seeking to use involuntary commitment laws “to round up mentally ill people and deprive them of other liberties,” a rare criticism of the NRA from a Republican. An investigation into child sexual-abuse claims in Spain’s Catholic Church found 728 abusers among members of the clergy and non-clerical staff and 927 victims since the 1940’s. A 19-year-old in the United Kingdom who converted to extremist Islam during the pandemic and planned to carry out a terrorist attack was given six years in prison. The Canadian province of Nova Scotia is experiencing its worst-ever wildfire season, with more than 200 so far this year. Be Smarter
The Discord disclosures of highly classified national security documents by former Massacheusetts Air National Guardsman/racist freak Jack Teixeira contain one particularly startling revelation: Iran, according to U.S. intelligence, plan to enlist militants in Syria to step up roadside attacks against U.S. military personnel, including through the use of armor-piercing munitions. The escalation is reportedly part of a broader strategic effort between Iran and Russia to drive the U.S. from the region (don’t threaten us with a good time!) but could also lead to escalating hostilities between the U.S. and Iran—and just in time for the Republican presidential primary, which will be chockablock with bloodthirsty war hawks who would happily exploit carnage in the region to revamp the GOP push for war.

2023.06.03 08:30 BruhEmperor Presidential Term of Thomas Custer (1889-1893) American Interflow Timeline
| After 12 years of trials and errors, Thomas Custer would finally rise and claim the presidency in a Post-Barnum era. With the nation being fundamentally changed in the past 8 years and with the effect of Barnum’s administration still very prevalent, like the still persistent Revelationist and Communard issues, Custer would need to uncharacteristically tread carefully to prevail in such a climate. President Thomas Custer’s Cabinet Vice President - Alfred A. Taylor Secretary of State - Francis Cockrell Secretary of the Treasury - Adlai Stevenson I Secretary of War - John Potter Stockton Secretary of the Navy - Arthur Sewall Secretary of the Interior - Thomas Goode Jones Attorney General - Jesse Root Grant II Secretary of Sustenance - Sylvester Pennoyer Secretary of Public Safety - Lyon G. Tyler (resigned May 1891), John R. McLean (read about the campaigns against the radicals here) Left? Right? No, Custerite! During his election campaign, the president promised a wide-range of groups things he would do in a future administration. Appealing to liberals, conservatives, nationalists, populists, militarists, anti-imperialists, and pro-reconciliationists, Custer would be flexible and non-partisan in his policies in order to fulfil such promises. Custer would first appeal to the anti-imperialist wing of his support by renegotiating to United States' promised port in the Congo during the Berlin Conference, crafted by Secretary Francis Cockrell, the United States would sell their land claims to the French on August 1889 for $1,250,000. The move would receive praise from anti-imperialists like Senators George Boutwell (F-MA) and Grover Cleveland (C-NY), and Representatives Edward Atkinson (C-MA) and John Wanamaker (P-PA), although opposition was brought in by some Commons and the old Barnumites like Representative William McKinley (F-OH). Land designated for the United States (dark blue) were sold to the French Empire Appealing to the pro-reconciliationists would be a harder feat than any of this. Ever since the end of the Civil War, stigmatism between the black and white communities in the south grew, it was further boosted by the barring policy of the Davis and Hamlin administrations which divided communities between whites and blacks to prevent violence. Forced integration was implemented by Custer with the Integration and Co-operation Act of 1889 which merged local segregated communities and forced some citizens living in those communities to live within the other group's area. Anti-reconciliationists like Senator Arthur Pue Gorman (C-MD) and Representative Benjamin Tillman (C-SC) opposed the bill, as they were elected within or with the backing of a white-only segregated community, though the pro-reconciliationists, which composed of both of the old pro and anti Barnumites, populists, salvationists, and progressives pushed the bill to pass Congress. Capitol Building 1889 The act faced major scrutiny from both black and white anti-reconciliationists, which pushed it as dictatorial and a breach of their civil liberties. The case made it all the way to the Supreme Court of the United States in the case Jennings v. Gibbs, in which Florida county lawyer William Sherman Jennings sued Representative Thomas Van Renssalaer Gibbs (F-FL) for 'infringing on and decrying civil liberties' by his support of the act. Gibbs' lawyers sighted the act was to end possible future violence between the two groups and claimed it was for the overall wellbeing of the country and to the citizen as their move was paid for by the government itself and that it was within the government's authority to enforce such acts, while Jennings sighted the First Amendment, claiming to this act violated the right of petition the government as the citizens were more or less forced into integrating without a say. The court decided on June 10th, 1890, and sided 5-4 in favor of Gibbs, claiming that it was within the government's right to enforce such an act. Although the court did also sort of sided with Jennings, pushing that the citizens moved out of their communities must give their consent and approval of moving out. Justice Robert Roosevelt wrote the majority opinion: " It is within Congress' right to enforce such laws that they apply, although it is also important to receive the consent and approval of those being affect by the laws they apply, as without it is simple tyranny.". The Supreme Court just marked pro-reconciliation acts as constitutional. Lawyer William Sherman Jennings and Representative Thomas Van Renssalaer Gibbs With Custer getting the greenlight on reconciliation, he began to deal with those dissenting on his new laws. Some violence and unrest arose from anti-reconciliation protestors causing riots and clashes with the police, in one incident, an anti-reconciliation mob beat one police officer to death and threw in body in the streets. The incident shocked the nation and many demanded justice, this gave Custer the backing to enact another plan he had. In the span of June-August, thousands of anti-reconciliationist rioters were arrested and sent to ' re-education facilities' to be 're-educated' about their beliefs, those re-educated would be release after a month and if they caused more dissent they would be thrown back into the facilities to be 're-educated' once again. No one exactly knows what happens in the facilities but rumors going from torture to brainwashing are common, but those released from the facilities never talk about their experience there. Although, anti-reconciliation violence has been significantly reduced ever since the program was created. Custer's Politics for Dummies The Presidential Cabinet has always been more or less been aligned with the president's beliefs, although in this case, with the president's beliefs all over the place, the cabinet would be quiet diverse. Some would have quite populistic beliefs like Treasury Secretary Stevenson and Sustenance Secretary Pennoyer, some would be traditionally conservative like Navy Secretary Sewall, War Secretary Stockton, and Secretary of Public Safety Tyler, and some would be considered more liberal like Secretaries Cockrell and Jones, and Attorney General Grant. This caused some division in the cabinet, with many members having different opinions on issues, like the admission of more states in the plain, with the more populistic members being for it and the conservative ones being against it. Vice President Alfred A. Taylor, who was often the most moderate within the cabinet, often had headaches due to the amount of bickering in the cabinet, privately saying, " I would rather have been the presidential cook than a member of this cabinet.". Taylor was known for serving delicious Tennessee Cornbread during cabinet meetings and public events, which were from his own recipe. On the Congressional front, politics there too was starkly changing. The Radical People's and Christian Salvation Parties had faced a significant decline over the last election and were facing even complete dissolution. The bells did toll for the Salvationists, as on June 1, 1889, waiting for a train going from his hometown of Freeport, Illinois to Chicago, Senator Charles J. Guiteau was shot by an assailant who was connected to the Salvationists. The bullet did not puncture his heart though and he was immediately treated by doctors. The doctors, however, operated on him with unsterilized fingers and tools trying to find the bullet, and Guiteau contracted an infection which slowly weakened his health. Guiteau would pass away on June 30th, which ended a major figurehead for the Salvationists. With their main leader gone, the Salvationists and their party were now certainly going to fall, so once again they turned to the Populists to help, they proposed a merge of their parties, unlike the Visionary Alliance back in 1884, this move would be permanent. A joint Radical People's-Christian Salvation convention was called in D.C., in which they decided to form the Reformed People's Party which would incorporate both Populist and Salvationist agendas. All Salvationists and Populists would run on this party's banner starting on the 1890 midterms, causing a wave of new support of their joint movements to grow. Representatives like Jerry Simpson (RP-KA), Charles Tupper (CS-NS), and Marion Butler (RP-NC), and Senator John P. St. John (CS-KA), although notably the party leader Senator James B. Weaver (RP-IA) did not outright support the merger. Representative Jerry Simpson and Senator John P. St. John. Troubles also arose within the ruling party itself. With Custer's moves in office being controversial not only nation-wide but also within his own party. Many Commons were repulsed by Custer's appeal to nationalists and populists, like his push for isolationism, labor reform, free trade, and anti-gold standard policies, which saw as the reason why the current economy was entering a small recession. The Custer administration was also known as notoriously corrupt, though Custer himself was more blind to the issue than actually involved in it, it was well-known that politicians like Secretary Tyler were making backdoor deals with businessmen like J.P. Morgan and Andrew Carnegie, even personally aiding in putting down worker strikes. Representative William Kissam Vanderbilt (P-NY) even once said, " The difference between a crafty serpent and a pro-big business politician? They have heels, I suppose.". These anti-reform and anti-Custerite politicians within the Commonwealth Party were called ' Reactionaries'. The reactionaries would included members like Senators Arthur Pue Gorman and John M. Palmer (C-IL) and Representatives like John Carlisle (C-KY). The reactionaries would form a major bloc within the party, often favoring militarism and traditional values in Congress, as seen from there opposition of the pro-reconciliation bills and their support for things like the gold standard and imperialism. But also from the other side of the spectrum are the people who see Custer as not reforming enough. Although they weren't as loud as the reactionaries and still mainly accept the situation, many still want more reform coming from the high office. The groups members included the likes of Representatives Samuel M. Jones (F-OH) and Charles N. Felton (C-CA), advocating mostly for internationalism, taxes, anti-corruption measures, and tariff reduction. Though more extreme politicians like Jones would call for monopoly busting, strong regulation, and direct elections. Senator Arthur Pue Gorman and Representative Charles N. Felton would represent two very different sides of the same party The Freedom Party had faced its largest split since the Federalist-Freedomite split during Henry Clay’s term. After the elections of 1888, the former Anti-Barnumites had taken control of most major positions in the main Freedom Party after the Conservative Freedom Party remerged with them. Staunch Anti-Barnumites like the pragmatic Representative Thomas Brackett Reed and stanch conservative Senator William Pierce Frye (F-MA) would all head their party in Congress. The remaining former Barnumites such as Representative William McKinley sought to amend the wounds between their counterparts and began the works to begin reconciling between the factions. Though many Freedomites were unsure about reconciling with the other faction, members like McKinley, Reed, and Representative Henry Clay Evans (F-TN) were influential in eventually mending their relations by the 1890 midterms, showing a mostly fully united party. This also was partly helped by the fact that former President Phineas Taylor Barnum would call for his old party’s unification, which had some mixed reactions in the party. The aging former President P.T. Barnum who would later die on April 1891 (read here about the Military Crisis of 1890 here) The Military's Resolve The government would once again refused the military extremists' demands of increased power. As such, the 700 or so extremists would attempt to storm the White House, with others were sent to seize government buildings and offices against the capitol. The D.C. police was immediately called to hold back the group and a shootout immediately ensued outside the White House. 2 hours passed as the shootout continued and both rebels and police were shot dead, the White House received significant damage due to artillery brought by the rebels, with some rebels even entering the now evacuated building. As the 3rd hour mark hit, military loyalist finally arrived at the scene, led by Harrison Gray Otis and Arthur MacArthur, the 3,000 loyalists sent engaged the rebels who were now resorting to guerilla warfare. 3 more hours would pass as the loyalists would trek to find the rebels scattered around Capitol Hill, it finally cease as the loyalists would find and capture both Jacob H. Smith and J. Franklin Bell hiding in an abandoned building, the remaining rebels would surrender in the 7th hour. Over 500 people would die in the so-called " Battle of Capitol Hill". Government loyalist in the outskirts of D.C. looking for rebels The affair caused a uproar across the nation, with some siding the government claiming the military was being spoiled, while some supported the rebel's calls claiming the remaining restrictions were still ruining their careers. It also divided the military more, with some siding with the loyalists and some adhering to the rebel's calls. Fears began to rise of a second Civil War due to such divisions, as some Reactionary politicians began to support the militarist cause. Immediate calls within the government were pushing for appeasement to the militarists to avoid another rebellion. Thus negotiators began to work on something to ease the stress of the military resulting in quite the controversial move. The 16th Amendment to the United States Constitution would add 9 seats to the House of Representatives that would be designated for the military. Called the 'Military Representatives', 9 servicemen would be chosen from either branch of the military to serve as Representatives for the military's interests. The Representatives would be appointed by the president and approved by the Senate and members could be removed by the president during House elections. The amendment was ratified with astonishing speed, being ratified only two months after it was proposed on February 23, 1891 right before the 52nd Congress met on March 4th. Custer also personally backed the amendment, with others like Representative Thomas B. Reed and William Kissam Vanderbilt supporting it. The 9 Military Representatives were sworn in along with the other 349 normally elected Representatives. Despite the amendment being quickly ratified, it still faced major opposition from anti-militarists and especially the remaining Populists and Salvationists. Representative Henry Clay Evans about the amendment, " If this amendment were to pass, we would be nothing but lapdogs to the armed forces, always in fear of a military rebellion.". Senator Daniel W. Voorhees (P-IN) stated, " Giving any more powers to the military would strip our fairly elected government of independence and reason, as fear would now dominate our politics.". Speaker Alexander S. Clay (C-GA) would be ousted as Speaker by John Wanamaker after the midterms in an anti-Commonwealth vote, Clay would later state, " Was supporting the amendment to the Constitution the right action? I do not know that answer. Yet I know one thing. It was the only action there was." Results of the 1890 House of Representatives Elections Results of the 1890 Senate Elections Tommy the Man After the meltdowns of the past two years, Custer would focus in his domestic and foreign policy. Custer would continue his pro-reconciliation policies, achieving slow success across the south, with some forcefully integrated communities prospering and with some having being burnt to the ground. Both pro-labor and pro-business policies would be implemented, such as an 8-hour work day and a shorter work week, other than this, businesses would be usually deregulated and were given reigns in handling any of their practices, with businessmen such as J.P. Morgan, Andrew Carnegie, and John D. Rockefeller emerging as powerful figures nationally, with their monopolies being wide reaching. Cartoon mocking the rise of corporations and their growing power over politics Custer's more reformist policies would deter some of his allies against him, as the likes of Public Safety Secretary Lyon G. Tyler, who disliked Custer's rowdiness in politics in general. Tyler basically had enough went Custer vetoed many legislations that were drafted by the Commons themselves. Tyler resigned as Secretary on May 1891, being replaced by the more moderate John R. McLean. Despite being bashed for his reforms, Custer would also be criticized for his more conservative policies too. A believer in laissez-faire economics and free trade, Custer would refuse to intervene in the economy even when it entered a recession during 1890-91. Custer would often get criticized for allowing big business to skyrocket out of control with their monopolies and trusts, though he would claim his concern was only of the workers' well being. Governor Nathan Goff Jr. (P-VA) would criticize Custer's domestic policies by stating, " Protectionism, direct elections, and internationalism are core things we need in this day and age, not only in Virginia but nationally, yet the president has rejected all of them.". Custer's domestic policies would see opposition from the new reformed populists, which called the Commonwealth Party the party of ' Business, Booze, and Boors'. Custer, despite being a self-proclaimed 'isolationist', often had interest in foreign affairs yet couldn't act on them as fearing it would deter his supporters. When war broke out in South America in December 31, 1891, when Argentina, who is run by the dictator Nicholas Levalle who recently staged a coup against the government, and Bolivia invaded Chile and Paraguay (more on in the foreign events section), Custer privately sought intervention in favor of Chile and Paraguay to preserve their democracies. Yet Congress and the general public were staunchly against any intervention in South America as they saw as another foreign war. Anti-intervention sentiment grew even further when the Empire of Brazil intervened in favor of Chile and Paraguay on April 1, 1892, their force now being called the ' Continental Alliance', causing the scale of the war to increase and the death toll to grow. Though the public opinion was firmly sympathetic to the Continental Alliance, some in government sought to aid the ' Golden Alliance' of Argentina and Bolivia, as they saw helping them as a way to control their economy and politics, though yet again the majority rejected intervention. Custer did consult his cabinet on what to do on the matter, which Secretaries Sewall and Jones were in favor of intervention, though other like Secretary Cockrell and Attorney General Grant were against it which ultimately led Custer to not intervene for the time being. The US did sell highly demanded imports to both sides of the conflict, which yielded major profit. - Major Foreign Events - The War Down Even More South High inflation, corruption, and bad worker rights in Argentina caused major unrest against the government. The Revolution of Park broke out against the government then run by the conservative National Autonomist Party on July 26, 1890. The rebels captured an arms and ammunition facility in the city and began to arm themselves as government began to apprehend them. The government forces were caught off guard by the now armed rebels and were forced to retreat, the rebels then turned to the Casa Rosada and the president, the revolutionaries successfully broke through the guards and stormed the building, forcing President Manuel Celman to resign. A revolutionary junta was put in place of the government as a new larger government loyalist force was organized to recapture the capitol, which led was by General Nicholas Levalle. The loyalist force successfully defeated revolutionary resistance in the capitol and entered the Casa Rosada, the revolutionary junta was defeat although President Celman had been executed and Vice President Pellegrini had fled the city. Levalle, seeing an opportunity, declared himself emergency president, even rejecting Pellegrini when he returned to the city. Over the past months, Lavalle would style himself with dictatorial powers over the Argentine government, which only fueled his ego. General Nicholas Levalle of Argentina Lavalle was a man who opposed the resolve of the border dispute between Chile in Patagonia which restricted Argentina outside the Pacific Ocean. In tandem, Bolivia's Gregorio Pacheco, who succeeded his very pro-Chile predecessor, had designs on Chile after Bolivia had lost the War of the Pacific, as well as Paraguay. Lavalle had secret meetings with Pacheco regarding their plan on Chile, later including Paraguay to the discussion, many meetings later and they decided on a plan to demand land from both nations. Their militaries were built up in the coming months to prepare for the incoming conflict. On December 26, 1891, Bolivia sent an ultimatum to Chile demanding their coastal provinces lost in the War of the Pacific to be returned, Argentina would back them the next day. On the 27th, Bolivia demanded full recognition of the control of the Chaco region from Paraguay, which Argentina backed the same day. Given until the 31st to respond, the Chilean and Paraguayan governments refused to respond to the ultimatums, so on the 31st, Bolivia declared war on Chile and Bolivia, Argentina would declare war on January 2nd. The campaigns at first favored the 'Golden Alliance' of Argentina and Bolivia, which saw advanced in the north of Chile and southern Paraguay. By February, the Golden Alliance would be nearing the Paraguayan capital of Asuncion, which worried their neighbor to the east, the Empire of Brazil. Empress Isabel I was facing a waning popularity, especially after her father abolished slavery, and the public were firmly against the Golden Alliance. Fearing Argentina's and Bolivia's victory would shatter trust in her even more, she decided to intervene. An ultimatum was sent to Argentina, dictating to end the war or face a blockade, the Argentinians ignored the order. Brazilian ships would begin a naval blockade against Argentina, but oddly some ships were ordered to go dangerously close to the Argentina coast on February 25th. As the ships grew near, the Argentine coast guard were unable to recognize the vessels and assumed they were Chilean and open fired. Despite Argentina apologizing for the incident, the affair caused enough outrage in Brazil to secure that a war was a certain. Brazil declared war on both Argentina and Bolivia on April 1st, forming the 'Continental Alliance' with Chile and Paraguay. The war would rage on from April-August as many foreign nations watched, with both sides gaining the upper hand many times and thousands dead or wounded. By August, both sides would be exhausted by war and bloodshed and needed something to tip the scales. 2023.06.03 03:25 clutchdeft City councilors to consider $1 million or more settlement in Trump rally lawsuit
City councilors on Wednesday will discuss and possibly vote on whether to pay $1 million or more to settle a lawsuit filed by a former elementary school art teacher who was arrested on a public street outside then-President Donald Trump’s June 2020 campaign rally at the BOK Center.
The City Council is required to approve settlements of $1 million or more. The matter is scheduled to be discussed in executive session at the council’s 4 p.m. meeting, with a possible vote in open session, according to the City Council agenda.
Sheila Buck filed the lawsuit in Tulsa County District Court in June 2021 against multiple defendants, including the Trump campaign, the city of Tulsa and two Tulsa police officers, C.J. Rhoades and Matthew Parker, alleging various civil rights violations.
The lawsuit — which was later moved to federal court — claims that Trump’s campaign had no legal basis to give the Tulsa Police Department power to arrest Buck and that Trump’s rhetoric before the rally toward those who might oppose his political message factored into how the Trump campaign, and by extension Tulsa police, treated her on the day of her arrest.
Buck had a ticket to the event and passed through security on her way into a cordoned-off area outside the arena when a member of Trump’s campaign staff asked the Secret Service, a private security firm and Tulsa police to remove her from the premises, according to court filings.
When she was told she was not allowed in the cordoned-off area, Buck showed her event ticket and insisted that she had a right to stay, at which point she was informed that she would have to leave, according to court filings. She eventually was arrested by Rhoades and Parker and taken to the Tulsa County jail, where she was booked on a misdemeanor complaint of obstructing a police officer.
At the time, Buck was wearing a black head covering and a black T-shirt with the words “I Can’t Breathe” on the front — a reference to words spoken by George Floyd in Minneapolis and Eric Garner in New York during fatal encounters with police.
In an opinion and order issued last year in response to the defendants’ motions to dismiss, U.S. District Judge Claire Eagan noted that the Trump campaign did not apply for a city permit, “which is generally required to block public street access around the BOK Center.”
The judge also wrote that Buck “has plausibly alleged that she was removed because of the content of her protected speech.”
“That is, government actors — acting at the direction of the Trump Campaign, a private organization that did not have authority to control or restrict protected speech — removed plaintiff from a public forum because of her expressive attire," Eagan wrote.
The Trump campaign and the campaign's manager were dismissed from the lawsuit early in the proceedings.
Eagan also referenced a Tulsa Police Department Facebook post stating that officers at the location “will remove individuals only at the direction of campaign staff.”
Police also released footage from Parker’s body camera, which showed him telling Buck the campaign had a permit that allowed it to control access to the perimeter.
A city spokeswoman said previously that the campaign would not have needed a permit because of an exemption within city ordinances on special events for activities by a government agency “acting within the scope of its authority.”
The city told the Tulsa World in 2020 that the rally for Trump had been considered a private campaign event and also a federal government activity.
"The city can confirm the lawsuit was negotiated outside of court through mediation and will go to the City Council for consideration," a city spokesperson said Friday.
Daniel Smolen, Buck's attorney, did not respond to a request for comment Friday,
but he has said previously that Buck, who is in her 60s, decided she had to move out of Tulsa after her arrest was televised across the globe.
A Tulsa County District Court judge threw out the misdemeanor police obstruction charge against Buck last month.

2023.06.02 21:20 klay2021 Co parenting with my abuser
To start it out, I have a 5 year old daughter with my ex who is also my abuser. We were together for almost 2 years and I got pregnant unplanned within the first month or 2. Throughout my whole entire pregnancy, he was physically and emotionally abusive towards me. Fast forward to July of 2018 when I had our daughter and a few days after having her, his mother moved in with us to help take care of her and so I could also go back to work because my ex refused to have a job. 2 weeks after having my daughter I went back to work because I had no choice. His mother stepped up and helped take care of her. Little did I know that that was about to be one of the biggest mistakes of my life. While she did help take care of the child, she seemed to exert herself as superior to me, almost seeming that she felt she was my childs mother. She too, started to become very abusive and threatening towards me when she felt that I was going to leave her son and that would mean not seeing her grand daughter on an every day basis anymore. Both her and my ex would abuse me at the same time, in front of my daughter. Being that she was only an infant at the time, she didn’t really make much of what was going on other than she didn’t like it and it made her afraid so she would scream and cry at the top of her lungs. There are several instances where I thought truthfully that either my ex was going to kill me, or his mother was. And I was very afraid.
Finally in august of 2019 I left him. I never thought twice about it and I never looked back. Within the next month and a half I found my (now husband) and we have been together ever since. Around December or 2019 when I was going to share visitation with my daughter with her father (nothing was set up in court yet at this time) he had her for his time and then we got into an argument over Facebook messenger and his mom got onto his account and messaged me that she was taking my daughter and to see her in court. Being that my ex was living with her too and took charge of the whole ordeal, there was nothing that I could do. My 1 year old baby (at the time) was taken from me and I was lest so helpless. I went to court and after 8 months went by I was finally able to see her again.
Long story short, both me and my ex have shared custody. Except I’m the primary custodial parent and he is not. We do long distance visitation with our daughter. He lives in Oklahoma and after that whole ordeal, I moved back home with my parents in Tennessee. We have 50/50 joint custody BUT, I am the primary physical custodian of our child. Not her rather. Co parenting with him has been nothing but a living fucking nightmare. They have called DHS on me numerous times simply because they don’t like the way things are right now. They speak badly about me to my daughter when it’s their turn to have her and they are trying to turn her against me in any way they can. She is also on an RX for severe constipation that she has had ever since I got her back from them the very first time after they wrongfully kept her away. Both my ex and his mother are so against my daughter being on this prescription that they are ultimately sending signals hinting towards them not returning her when they receive her tomorrow.
Given that my ex is abusive and has a history of it, he was required to take a 12 week domestic violence course. He was actually supposed to complete it last summer and never did so he lost last summers visitation. And this summer when we spoke about exchanging for summer break, he was again told that I needed to see the certificate of completion. And my response from him was “I’m taking you to court to enforce visitation and to modify the visitation schedule”. Last night he sends me a copy of a certificate from a 12 hour domestic violence course. After speaking with my attorney and her deeming that that would be considered acceptable by a judge in court, I guess I’m just blown away how 12 weeks magically equals 12 hours. The course was done last minute and it wasn’t even done by him, but his mother, who can really use that course for herself too.
So now tomorrow I have to drop my daughter off at the half way point from Tennessee to Oklahoma and do the exchange. And I am beyond devastated. I’m angry that she has to go over there all summer when what was required of him wasn’t done properly, I’m angry that he still manages to ruin my life, going on 5 years later. I’m TERRIFIED that him and his mother are going to run off with her again and they won’t drop her off on July 15th like they are supposed to. This is consuming my life. I’m happily married to my husband, we both have a daughter together and dealing with my abuser just sucks the happiness right out of me. I wish I didn’t have to deal with this for the next 13 years of my life. I guess what I am trying to get at is is there anyone in this group that is going through anything similar as me? Will this ever get better? I am at my limit with this and I’m suffering from PTSD from his abuse and also from his mothers. I feel like I failed my daughter by putting her in this position and not stepping up years ago and doing that right thing and leaving when I should have. But anyone that’s been abused knows that you can’t just up and leave the minute you want to.

2023.06.01 17:35 7GatosNoDinero Need help figuring out who to go to or what resources to utilize when property management company basically starts ignoring any attempts of contact
This isn't regarding maintenance or trying to contact the general receptionist but the "community director" in charge of my specific complex (and for clarity, this is regarding LeFever Mattson Property Management, which I know has had a few articles written about them which only makes this seem impossible to handle).
Phone number on the website for my apartment complex goes to voicemail with no follow up (even the receptionist at their main office stated it is possible that no one has access to those messages due to the transfer of ownership); and previous attempts of contacting more regional higher up staff members via phone numbers (direct to voicemail) has resulted in more silence.
Further background info in comments, but basically, it seems their plan of action is just...waiting the problem out.
Right now I am trying to get answers regarding the lease so that I can exit out while ensuring the current tenants can have an online account to pay their lease; there's other stuff, but that's mostly it. Oh, and that they were incorrect about charging me $35 instead of $25 for a returned check charge (they even quoted the lease that lists the exact legal code that states that the first charge can be maximum $25); it's only $10 so really it is the principle of the thing that they can be pointed to the law and they just ignore my e-mails again.
I asked for the community director's direct supervisor, again ignored.
I don't know what to do, I done "following up on my previous e-mail" so many times, and nothing. I just want to leave to handle my family situation with all my affairs with this apartment in order (paperwork to exit lease, login accounts for housemates, etc.), but it's like nothing is happening and I don't want to be that person harassing the front desk receptionist (who is very nice!) in hopes to get an answer from the community director.
Any suggestions would be appreciated.
Update; did another round of calls to try to get in contact with someone as a last ditch effort before I load the car with the last of my stuff to leave, and finally got in contact with the community director (context: same person I sent 3 e-mails with no response, May 8th, then May 11th and May 19th with the last two with the regional director cc'd) via phone call. Turns out she doesn't have access to the voicemail listed for the apartment complex on the website, only her direct phone lines (which were given via paper taped to doors earlier this year). She states she will finally add my housemates (who did fill out the applications months prior) to have online accounts, and also re-took out my housemates who left back in August :,) She was very nice, but also am like,,,,but why did this take so long? (internally, I didn't say anything to her) As for the $10, I clarified that it was only the first charge (which I had multiple times in e-mail) and then she stated "Oh, I didn't realize that" so she'll forward it to the attorney and Sacramento regional manager (who I left a voicemail) for clarification. I clarified that I used the ca gov website for exact wordage of the legal code so it wasn't like a random google search.
I thought I would be just doing more voicemails so am surprised that someone finally picked up and the changes I been waiting for months will happen, which is great cause I am literally leaving to return to Mexico to help with more family stuff today and thus will have no cell service...so yay? But also,,,,am frustrated that unless I get someone on the line, stuff just won't happen with this company. (except for maintenance and the receptionist person, they're solid)
